For this episode I will be speaking to Ian Ballon about Data Protection regulation in the modern age. Ian is a practicing U.S. attorney, IP and internet litigator, and Co-Chair of U.S. law firm Greenberg Traurig’s Global Intellectual Property & Technology Practice Group. Ian is also author of the five-volume treatise, E-commerce and Internet law: Treatise With Forms. In addition, he serves as the Executive Director of Stanford University Law School’s Center for the Digital Economy.
We will be discussing the increased attention afforded to data protection since the rise of “Big Tech” firms such as Amazon, Facebook, Google, Apple, to name but a few. The U.S.’s approach to antitrust law (commonly known as competition law in the EU) will also serve as an interesting and relevant aspect to this debate by discussing the extent to which privacy ought to serve as a “non-price” element in antitrust analysis. The U.S. has also recently been privy to the adoption of EU GDPR-style privacy legislation through a patchwork of laws, with the California Consumer Protection Act (CCPA) serving as the most robust and authoritative one to date. How likely the chance is, and how effective it is, for the U.S. to adopt federal privacy legislation in order to steer away from its current “patchwork” of data privacy regulation will shed light on what a potential future trajectory of data protection regulation will look like.
