A jury ordered Rudy Giuliani to pay Georgia election workers Shaye Moss and Ruby Freeman $146 million for lying and defaming them, and endangering their lives in the process. Ever since the jury handed down that judgment, Giuliani has been ducking, dodging, and deceiving - in efforts to avoiding paying out on the money judgment.

Now, Shaye and Ruby have filed a motion in federal court in New York seeking to seize Giuliani's assets: his multi-million-dollar apartments and condos in New York and Florida, his high-dollar sports memorabilia, his extensive luxury watch collection, his diamond jewelry, etc., in an attempt to satisfy the money judgment.

It looks like Rudy is running out of rope.

Special Counsel Jack Smith and Donald Trump's criminal defense attorneys have filed a joint scheduling proposal with Judge Tanya Chutkan regarding their respective suggestions on how to litigate the absolute immunity issue in the aftermath of the Supreme Court's ruling that a president's official acts might be immune from prosecution. Smith informed the judge that he is prepared to file a motion disclosing all of the "unpled" evidence and information of Trump's crimes, meaning evidence that was not disclosed in the first or second (superseding) indictments in Trump's election subversions case in DC. This disclosure is necessary so the judge can fully litigate the issue: which of Trump's crimes and conduct are immune from prosecution and which are not. Jack Smith informed the judge that he's "prepared to file" the brief "promptly at any time the Court deems appropriate." Not surprisingly, Trump's attorneys said in the joint filing that they don't want to litigate the immunity issue any time soon - if at all. Glenn discusses the implications of this new court filing and the next decisions to be made by Judge Chutkan.

In the wake of the horrific Supreme Court opinion granting presidents immunity for committing democracy-busting crimes against the American people, Jack Smith decided to seize the initiative. Rather than waiting until the litigation before Judge Tanya Chukka to sort out the implications of the new Supreme Court ruling, Smith went before a new grand jury, and presented only evidence of Trump's unofficial acts that violated the law - removing from the case Trump's acts that could have run afoul of the Supreme Court ruling - and asked the grand jury to vote out a new indictment.

The good news on the accountability front is that even removing evidence of Trump's "official presidential acts" from the case, the grand jury STILL concluded that there was ample evidence to indict Trump on the same four felonies that appeared in the original indictment.

Special Counsel Jack Smith has filed an appeal with the 11th Circuit Court of Appeals, urging them to REVERSE Judge Aileen Cannon's dismissal of Trump's classified documents/obstruction of justice/espionage case.

Jack Smith made clear that Cannon's dismissal has no legal support and is contrary to all precedent, including precedent from the Supreme Court dating back to the Nixon/Watergate era. As Smith writes, Judge Cannon's dismissal of Trump's case "conflicts with an otherwise unbroken course of decisions, including by the Supreme Court, that the Attorney General has such authority, and it is at odds with widespread and longstanding appointment practices in the Department of Justice and across the government. This Court should reverse."

Glenn goes over the next steps in the process and discusses what happens if Jack Smith wins the appeal and what happens in the (unlikely) event Donald Trump wins the appeal.
